The Election Commission of India (ECI) took a significant step on Sunday by announcing the deployment of Central Observers, comprising General, Police, and Expenditure observers, for upcoming elections. This deployment aims to oversee the Bihar Assembly elections and bye-elections in eight assembly segments, notably in Budgam and Nagrota constituencies in Jammu and Kashmir.
This strategic move falls under the ECI’s plenary powers as defined in Article 324 of the Constitution and Section 20B of the Representation of the People Act, 1951. The observers will ensure the smooth and impartial conduct of elections within each constituency.
Following weeks of speculation, the announcement confirmed the schedule for long-awaited bye-elections in Jammu and Kashmir’s 90-member Legislative Assembly.
- The Nagrota seat became vacant after the sudden passing of senior BJP leader Devender Singh Rana on October 31, 2024, shortly after Assembly election results on October 8, 2024. There is growing speculation about his daughter, Devyani Rana, potentially contesting for the party, although no official confirmation has emerged.
- In Budgam, Chief Minister Omar Abdullah vacated his seat on October 21, 2024. After successfully contesting from both Budgam and his stronghold of Ganderbal, he chose to retain the latter. The National Conference appears strong in Budgam, but the party has yet to finalize a candidate.
The ECI has mobilized a total of 470 officers, which include 320 from the IAS, 60 from the IPS, and 90 from IRS/IRAS/ICAS services, as observers for the Bihar Assembly elections and the bye-elections.
These observers act as the eyes and ears of the Commission, tasked with ensuring the fairness, transparency, and credibility of the electoral process. Their responsibilities encompass:
- Monitoring the conduct of polls under the ECI’s superintendence.
- Overseeing law and order, campaign conduct, and electoral management.
- Tracking candidates’ election expenditures to prevent malpractices.
- Enhancing voter awareness and participation across the constituencies.
“The observers are entrusted with the crucial responsibility of upholding the impartiality and credibility of elections – the bedrock of democratic polity,” the ECI stated.
The Commission is poised to reveal the Bihar Assembly election schedule by mid-October. Additionally, October 24, 2025, has been designated for the biennial elections to four vacant Rajya Sabha seats from Jammu and Kashmir. As the nation heads towards these pivotal polls, the role of the ECI and its observers remains vital in upholding democratic principles.
